…10. White has blatantly indicated that no matter what the judgment, he intends to do everything possible to hide assets and frustrate collection of the judgment and the administration of justice. In one of White’s recent filings, White states: “The question is what terms are the judgment creditors [Unnamed Citizens] . . . willing to accept? Given that Debtor can simply operate under a company name and avoid the judgment indefinitely, there may not be a point in maintaining any property in his name any longer.” (Dkt. no. 538, p. 4).

11. Due to Debtor’s avowed intention to frustrate collection it is the position of the Unnamed Citizens that they would be better served by dismissal of the action. Given that Debtor is still incarcerated, and may be incarcerated for many years, the interests of the Unnamed Citizens are better served by being able to act quickly to attach the few assets remaining in the estate. Converting this case to a Chapter 7 case would do little more than waste the time of the Chapter 7 Trustee and the assets of the estate paying for the costs of administration.

WHEREFORE, the Unnamed Citizens respectfully request that this Court deny William A White’s Motion to Convert to Chapter 7 and grant the U.S. Trustee’s Motion to Dismiss; and for such other and further relief as may be proper.

For the record: Oct 3rd, Bill White tries to locate his property manager and find out what is happening with his business See end of the article “Things Get Worse…”. (The property manager was soon located but she resigned almost immediately after that. Bill White commented – “Jody screwed up”.)

Also, from sources in Beckley, I hear that even before he went into “the hole” around September 3rd, Bill White mentioned to a friend something about the water company turning the water off at his properties. There’s been an ongoing legal feud with the water company throughout the bankruptcy.

EVICTING THE TENANTS -From what I have heard from sources in Roanoke, most of the tenants stopped paying their rent after the civil suit in August, and they kept running up the water bills, which Bill has to pay. This was draining Bill’s resources and a sure road to foreclosure on the properties. Because Bill has been in prison for two years, he didn’t even know which of his properties are occupied or what the tenants’ names are, or what physical damage they might have done to his properties – items he needs to know to do routine eviction notices.

Held in Prison for Thought Crimes and Defiant Speech, Bill White Tries to Manage his Properties from “the Hole”.

Several tenants of Roanoke city landlord and Neo Nazi leader Bill White claim, even while in prison, he still causes chaos.

Court records show White had the water cut off to approximately 20 tenants. The tenants claim the Western Virginia Water Authority took their meters on November 9th.

“If I had been give proper notice, even a 30 day notice, that would have given me proper time to make sure we had somewhere to go,” Patricia Quackenbush said.

Quackenbush said she signed a lease with White’s wife, Meghan, more than one year ago.

Bankruptcy court records show White put his wife in charge of his rental property business when he went to jail two years ago.

White will wrap up a federal prison sentence soon after convictions late last year on charges of threatening people and intimidating several tenants at a Virginia Beach apartment complex he did not own.

White still faces a possible criminal trial in federal court in Chicago on a charge of threatening a juror.

Quackenbush called the Legal Aid Society of the Roanoke Valley were attorney David Beidler took her case.

Beidler said he knows White very well. He said someone once posted his home address and other personal information on the Internet after successfully defending one of White’s former tenants in an unrelated matter.

Beidler said he hasn’t gathered all the facts but “expects” it could be a case of White trying to get the tenants out of his rental properties without going through the legal means of eviction as spelled out in commonwealth law.

Beidler wrote a letter to the Western Virginia Water Authority claiming White did not give his tenants enough notice before shutting off the utility.

The authority agreed to put the water meters back at the properties for the next 30 days.

Beidler said it’s completely within White’s rights as a landlord to evict any tenants as long as he follows the rules, which usually give tenants more than 30 days notice.

White has been acting as his own bankruptcy attorney for the past several months. He’s currently serving his time in prison in Beaver, West Virginia.

Court records show White filed paperwork claiming his wife had gotten behind on the water bills, and an August filing accused her of stealing $60,000 from his estate.

Meghan White refused a request for an interview for this story.

In later filings White told the bankruptcy judge he had interest from an undisclosed buyer about purchasing the properties where he had the water turned off.

White filed for Chapter 11 bankruptcy in 2008, but asked the judge to change his filing to Chapter 7 protection. If the judge disagreed, White said he would “eliminate the remaining tenants through condemnation, lease termination, and eviction.”

White wrote his reasoning for turning off the water was due in part to his “previous property manager” ceasing to pay the water bills and “misdirecting the funds.”

In a letter to Roanoke city code enforcement dated November 8th, White wrote his wife “is almost completely out of this situation” and that if Meghan White “steals or misdirects another month’s rent roll,” he might walk away from any negotiations to fix the properties.

At the bottom of the letter White wrote: “PS: I am very sorry to you and the city for what my wife has done.”

Quackenbush believes White still wants her evicted. She said she’s already looking for a new apartment.

Roanoke neo-Nazi files for bankruptcy
William White is seeking Chapter 11 protection after what he called a “cash crunch.”

Four years after coming to Roanoke and starting a rental home business that quickly drew attention to his role in the white supremacy movement, William White has filed for bankruptcy.

White, a neo-Nazi activist who is perhaps better known for his virulent Internet postings than as the owner of White Homes and Land LLC, recently sought Chapter 11 bankruptcy protection.

In a petition filed last week in U.S. Bankruptcy Court for the Western District of Virginia, White listed assets of $1.9 million and liabilities of $1.4 million.

White, commander of the Roanoke-based American National Socialist Workers Party, was one of the country’s few white supremacy leaders with a viable business, giving him both credibility in the movement and the financial means to spread his racist views, according to one expert on hate groups.

“Now that’s gone, and I think he has very little left,” said Mark Potok, director of the Intelligence Project for the Southern Poverty Law Center.

“It’s a remarkable end for a guy who simply can’t stop bragging about what a brilliant businessman he is.”

According to an SPLC report issued earlier this year, White came to Roanoke in 2004 to start a real estate business, maxing out several credit cards for the capital to purchase the first of about 20 homes he currently maintains as rental properties in an impoverished part of the city’s West End neighborhood.

About the same time, White began to post racially charged comments on his Web site, complaining about his black tenants and suggesting that he would evict them as part of a “ghetto beautification project.”

A federal housing discrimination complaint filed by the local chapter of the National Association for the Advancement of Colored People produced no charges against White, who continued to use overthrow.com as a forum to comment on race relations both in Roanoke and across the country.

White said Tuesday that his reliance on credit cards had nothing to do with his financial difficulties, which he attributed to medical bills of more than $130,000 from the recent hospitalization of his wife and newborn daughter.

“We’re just reorganizing some debt,” he said.

“The property is certainly not underwater. We have plenty of money in it, but we just had a temporary cash crunch.”

White said he has been planning for some time to sell his rental homes. He said the bankruptcy proceedings should have no effect on his home construction business or on his role as leader of his neo-Nazi organization.

Although White discounted the role that credit cards played in his financial difficulties, a list of his 20 largest unsecured creditors in the bankruptcy filing includes more than $52,000 in credit card debt.

White said he has paid off the credit card used at the start of his business.

As assets, White listed 13 rental properties on Chapman and Patterson avenues with a combined value of more than $1.3 million. He also listed about $565,000 in personal property, the bulk of which he said came from his interest in White Homes and Land. The remaining seven rental properties are listed in the name of White’s company and were not included in his personal bankruptcy.

Another section of the 70-page bankruptcy petition contains evidence of White’s cash-flow problem: While his business grossed about $550,000 in 2007 and $541,000 in 2006, income to date this year was listed as just $78,797.

White’s financial problems come at a time when his neo-Nazi activities have been getting more attention.

In perhaps his most publicized controversy, White used his Web site in August to post the names and addresses of the defendants in the Jena Six case, a racially charged assault proceeding in Jena, La. Next to the black defendants’ contact information, White posted the words: “Lynch the Jena 6.”

Although the FBI said at the time it was investigating White’s actions, no legal action has been taken against him in connection with the Jena Six case.

More recently, White tangled with lawyers involved in a housing discrimination case in Virginia Beach. After White inserted himself into the case — sending racially charged letters to black tenants who had sued their white landlord — lawyers for the plaintiffs asked a judge to impose sanctions against him. The judge has yet to make a decision in that case.

Regardless of what happens to White in bankruptcy court, Potok acknowledged that it will likely have little influence on his penchant for posting nasty and Nazi-inspired views on the Internet.

“My guess is that Bill White will continue to try to be a player in the movement,” Potok said, “because he has an ego as large as the planet.”
